Dallas Crown
sues for temporary injunction
Dallas Crown challenges the
order by the
city of Kaufman for closure of the local
horsemeat plant.
Not surprising anyone, last Monday, Dallas Crown
(horsemeat plant operator) and Waldo, Inc.
(owner of property) had their attorneys file
suit in the 422nd District Court. They are
asking that the city of Kaufman is
prohibited from closing the plant.
Dallas Crown was ordered by the city's Board
of Adjustments close by Sept. 30. The
horsemeat plant has been cited a public
nuisance. Citizens living on adjacent
properties complained that the horsemeat
plant is a health and safety hazard.
The attorneys claim that the suit is unfair.
The suit has three claims:
1. The board acted improperly and beyond its
jurisdiction in ordering
the plant closed.
2. Board members were prejudiced against the
plant and therefore not giving
Dallas Crown a fair and impartial trial.
3. The action was arbitrary, not supported
by evidence and based on
unreasonable ordinances. Attorneys for the
plant are asking the court to initially
issue an
injunction allowing the plant to remain
open.
Should the court not grant temporary
injunction, the attorneys requested
reimbursement for monetary damages.
